1. Guests are required to send a copy of photo identification prior to check-in.
  2. A security deposit of CAD 350 is required 48 hours prior to arrival for incidentals. This deposit is fully refundable upon check-out and subject to a damange inspection of the accommodation. A 50% refund for booking costs is provided until 30 days prior to arrival. No refunds are provided for cancellations made less than 30 days in advance. Cleaning fees are fully refundable if the guest does not check in.  
  3. Guests agree that the number of overnight guests will not exceed the number of guests submitted in the reservation request, and that all guests shall comply with the booking policies.  
  4. The Property is provided in “as is” condition. The Rental Agent shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, kitchen appliances, cable TV access or fireplace as applicable. The Rental Agent shall not be held responsible for such items failure to work, but will make every effort to correct any issues as reported as quickly as possible.
  5. Guests acknowledge that use of amenities such as fireplaces, kitchen appliances, decks, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children and such use is at the Guests’ own risk.
  6. Guests shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times.
  7. Guests and any additional visitors shall refrain from loud noise and shall not disturb, endanger, or inconvenience neighbors, nor shall Guests use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.  All music and noise at the property will be kept to a respectable level and in compliance with the Town of Canmore's Noise Control Bylaw 11-97.  Guests will be held responsible for any violation tickets received.
  8. Guests will be held responsible for any loss or damage to the Property caused by themselves, their guests or any person for whom they are responsible.  
  9. Smoking and illegal drugs are not permitted within the Property including the outdoor balcony.  
  10. Pets are not permitted within the Property.  
  11. Guests shall not assign or sublease the Property or permit the use of any portion of the Property by other persons who are not family members or visitors of the Guests and included within the number of and as permitted occupants under this booking request.  
  12. Guests agree that all personal property, furnishings, personal affects and other items brought into the Property by the Guests or their visitors shall be at the sole risk of Guests with regard to any theft, damage, destruction or other loss and the Rental Agent shall not be responsible or liable for any reason whatsoever.  
  13. The Guests hereby covenant and agree to indemnify and hold harmless Rental Agent and their agents, owners, successors, and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, attorneys fees incurred by Guests, permitted guests, visitors or agents, representatives or successors of Guests due to any claims relating to destruction of property or injury to persons or loss of life sustained by Guests or family and visitors of Guests in or about the Property and Guests expressly agree to save and hold Rental Agent harmless in all such cases.  
  14. The Guests hereby waives and releases any claims against the Rental Agent, the Property owner and their successors, assigns, employees or representatives, officially or otherwise, for any injuries or death that may be sustained by Guests on or near or adjacent to the Property, including any common facilities, activities or amenities.   The Guests agree to use any such facilities or amenities entirely at the Guest’s own initiative, risk and responsibility.  
  15. The Rental Agent reserves the right to enter the Property at reasonable times and with reasonable advance notice for the purposes of inspecting the Property or showing the Property to authorized persons.
  16. If the Rental Agent has a reasonable belief that there is imminent danger to any person or property, the Rental Agent may enter the Property without advance notice.  
  17. If Guests should fail to comply with the conditions and obligations of this Agreement, Guests shall surrender the Property, remove all Guests’ property and belongings and leave the Property in good order and free of damage. No refund of any portion of the Total Rental Fee shall be made and if any legal action is necessary, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.
